Summary of Notice:
The Northeast Dairy Compact Commission is extending the comment period, and holding an additional public hearing, on the proposed amendments regarding diverted and transferred milk. The Commission also proposes to amend the definition of "producer".
Supplementary Information:
Pursuant to its authority under Article V, Section 11 of the Compact, the Commission is extending the comment period on its previously proposed amendments to the Compact over-order Price Regulation to exclude milk from the pool which is either diverted or transferred in bulk out of the Compact regulated area, and is seeking additional comment and testimony on specific issues regarding diverted and transferred milk. The Commission is also proposing to amend the definition of "producer" to be consistent with the previously proposed amendments regarding diverted and transferred milk and to update this rule to include December 1998 as an additional requirement.
The Northeast Dairy Compact Commission will hold a public hearing as part of the rulemaking to take testimony and receive documentary evidence. The hearing will be held at 9:00 am on September 2, 1998 at the Holiday Inn, Capitol Room, 172 No. Main Street, Concord, NH (exit 14 off I-93 north).
3. Request for Pre-filed Testimony and Written Comments
The Compact Commission is requesting and encouraging interested persons to submit pre-filed testimony. The deadline for receipt of pre-filed testimony is 5:00 p.m. August 26, 1998.
The deadline for receipt of all documentary evidence submissions is 5:00 p.m. September 16, 1998.
Pursuant to 7 C.F.R. Part § 1361.4 any person may participate in the rulemaking proceeding independent of the hearing process by submitting written comments and exhibits to the Commission. Comments, exhibits and pre-filed testimony will be made part of the record of the rulemaking proceeding if they identify the author’s name, address and occupation, and if they include a sworn notarized statement indicating the comment, exhibit and/or pre-filed testimony is presented based upon the author’s personal knowledge and belief.
